The Consumer’s Right to Withdraw from the Distance Contract

Dear customers, we would like to inform you that in accordance with the Law on Consumer Protection (“Official Gazette of RS” No. 62/2014, 6/2016-other law and 44/2018-other law) purchases through our website (our online stores) www.anamibags.com is considered distance selling.
The Law on Distance Selling establishes the right of a buyer, who is considered a consumer (a natural person who buys a product to meet his individual needs, and not to perform professional activities), to withdraw from a contract concluded at a distance, ie outside business premises within 14 days from when the product was delivered to him, without the obligation to state the reasons for which he gives up and without costs, except for the costs of returning the goods and money. You do not bear the cost of returning the goods and money in cases when you receive a defective or incorrect item.

The consumer exercises the right to withdraw from the contract by a statement that he can give on a special form – Statement of withdrawal from the distance contract, which you can download here.

A statement of withdrawal from distance and off-premises contracts is considered timely if it is sent to the trader within 14 days from the day of taking over the product by the consumer.
The statement of withdrawal produces legal effect from the day it is sent to us as a trader.

If the trader enables the consumer to fill in and send the withdrawal form electronically, he is obliged to inform him about the receipt of the form without delay in writing or on another permanent record carrier.

After 14 days, your right to withdraw from the contract expires.

The burden of proving that he acted in accordance with the provisions of Article 28, para. 1-5 of the Law on Consumer Protection in order to exercise the right to withdraw from the contract, is up to the consumer.

The form and content of the withdrawal form shall be prescribed by the minister responsible for consumer protection.

Withdrawal from the contract

1. If you decide to withdraw from the contract before delivery of the product, your funds will be refunded to you no later than 14 days from the date of receipt of the withdrawal statement. The only cost you have in this case is the cost of a refund.

2. In case of withdrawal from the contract upon receipt of the product, it is necessary to return the product to us, no later than 14 days from the day you sent the withdrawal form. After the expiration of 14 days from the day you sent the cancellation, the product can no longer be returned. You can return the product via the courier service of your choice. In this case, the cost of returning the product and money is your cost.

3. If you get a product that clearly shows that it has an error / defect and that the error was not caused by improper use, ie. by acting in accordance with the statements in the accompanying declaration, you have the possibility to withdraw from the contract if there has been an error in production, packaging or transport. The return of the product is done through the courier service through which you received the same, and in accordance with the instructions you will receive from our operator. The costs of product returns and refunds are borne by www.anamibags.com.

Please keep in mind that as a customer you are responsible for product defects or damage resulting from inadequate product handling, ie. for impaired value of the product that arises as a result of handling the goods in a way that is not adequate. If it is determined that a defect or damage to the product has occurred through the fault of you as the customer, we will assess the level of damage. In accordance with the level of damage, and with your prior consent, we will reduce the amount of money returned proportionally or we will refuse a refund and the product will be returned to you at your expense.

Exceptions to the right to withdraw from the contract

The consumer has no right to withdraw from the contract in the case of delivery of goods produced according to special consumer requirements or clearly personalized (Law on Consumer Protection, Article 37, paragraph 3).

Money Returns

In the case of a refund for products paid for by one of the payment cards, we undertake to make a refund exclusively via the payment card with which you made the payment (VISA, EC / MC, Maestro and other electronic payment methods). At the request of the seller, the bank will refund the funds exclusively to the account of the card user from whom the product was paid for. If you paid for the products when taking over in cash, we undertake to pay the money either to your current account or to a payment card.

In no case, under any circumstances, can the buyer request a refund in cash, either for a transaction made using one of the payment cards, or for payments made in cash.

Personal Information Use

By filling in the Statement on withdrawal from a distance contract or a contract concluded outside the business premises, you provide us with data that are used to record changes in the movement of goods and they will not be used for any other purpose.
